What Does the Family Court Consider?

Interim Custody — What It Is and Why It Matters

During custody proceedings — which can take months or years — the court can grant interim (temporary) custody orders that determine where the child lives while the case is pending. It is critical to apply for interim custody at the very start of proceedings. The parent who has the child with them during the case often has a practical advantage. Courts are generally reluctant to disturb a child's settled living arrangements without strong reason.

Can a Father Get Custody?

Yes. Odisha courts increasingly grant custody to fathers, particularly when the child is above 5 years of age, when the mother is unable to care for the child due to health or other reasons, or when the father can demonstrably provide a superior care environment. Courts are not automatically biased in favour of mothers for older children. A father who has been actively involved in the child's upbringing, schooling, and daily care has a strong case.

Role of the Child Welfare Officer

In contested custody cases, the Family Court may appoint a Child Welfare Officer (CWO) to conduct a home visit and assess the living conditions, the parent's relationship with the child, and the overall environment. The CWO files a report with the court. This report carries significant weight. To prepare for a CWO visit: ensure your home is clean and child-appropriate, have the child's room, school bags, toys, and belongings present, and be natural and warm with the child during the visit.
