How to Apply for Vehicle Superdari in Odisha
A superdari application is filed under Section 497 BNSS before the Judicial Magistrate First Class having jurisdiction over the police station where a vehicle was seized, asking the court to grant interim custody to the owner or another entitled claimant, generally on a bond and an undertaking to produce the vehicle again if required.

The Process, Step by Step
1. Check the vehicle's current status. Find out, through the investigating police station or the court record, whether the vehicle has been produced before a Magistrate or reported to one under Section 503 BNSS. An application can only be filed once the matter is before a court.
2. Collect the required documents. Gather the registration certificate, a valid insurance policy, the purchase invoice or loan/hypothecation papers if financed, and your identity proof. If the vehicle is linked to an FIR, obtain a copy of the FIR and seizure memo.
3. Draft the superdari petition. Prepare a written application addressed to the Judicial Magistrate First Class having jurisdiction over the police station where the vehicle was seized, identifying the vehicle, the case it relates to, and the basis of your claim to interim custody.
4. File the application before the court. Submit the application through the court's filing process, along with the supporting documents. A copy is typically also made available to the investigating officer.
5. Attend the hearing. The Magistrate lists the matter for hearing, where you or your advocate present the application, respond to any objection from the police or another claimant, and address the bond/security the court may require.
6. Comply with the release order. If the application is allowed, take custody of the vehicle in line with the order's conditions, including any undertaking to produce it again if required during the case.
Situations That Need Individual Legal Advice
This guide describes the general process. It does not cover every scenario, and the following situations in particular tend to need case-specific advice rather than a generic application:
- The vehicle is connected to a serious offence where the police object strongly to release.
- More than one party — such as a co-owner, financier, or alleged buyer — claims entitlement to the vehicle.
- The vehicle was stolen and later recovered, which can involve an insurance settlement already paid out.
- The registered owner is themselves an accused in the case the vehicle is connected to.
Frequently Asked Questions
Can I file a superdari application myself, without a lawyer?
There is no legal requirement to be represented by an advocate, but a superdari application is a court filing governed by procedural rules, and an incomplete or incorrectly drafted application can cause delay. Many applicants choose to engage an advocate to draft the petition and appear at the hearing, particularly where the facts are not entirely straightforward.
Is there a court fee for filing a superdari application in Odisha?
Court fee schedules are set by the state and can change; the applicable fee for this kind of application should be confirmed at the time of filing rather than assumed from past figures. This is a detail best verified with the court or an advocate just before filing.
What if the police object to the vehicle being released?
The investigating officer may raise an objection — for instance, that the vehicle is still required for forensic examination or identification. The Magistrate hears this objection alongside the applicant's case and decides whether release can proceed, sometimes with added conditions, or whether it should wait until a specific investigative step is complete.
Does filing a superdari application affect the underlying criminal case?
No. The superdari application deals only with interim custody of the vehicle and does not decide guilt, innocence, or any other issue in the underlying case. The main case — whether a traffic prosecution, an accident matter, or a criminal trial — continues on its own track regardless of the outcome of the superdari application.
