Who Can File a Consumer Complaint?

Under the Consumer Protection Act, 2019, the following can file a complaint:

Step-by-Step Process

Send a legal notice first

Before filing a complaint, send a written legal notice to the opposite party giving them 15–30 days to resolve the issue. This shows the commission you attempted resolution and sometimes resolves the dispute without litigation.

Collect all documents

Gather receipts, invoices, warranty cards, email/WhatsApp communication, photographs of defects, and any other evidence of the transaction and the deficiency.

Draft the complaint

The complaint must state: your details, the opposite party's details, facts of the case, the deficiency or defect, the relief sought (refund, compensation, replacement), and a supporting affidavit.

Pay the filing fee

Consumer commission fees are nominal. For claims up to ₹5 lakh, the fee is ₹200. Up to ₹10 lakh — ₹400. Up to ₹20 lakh — ₹500. Up to ₹50 lakh — ₹2,000.

File at DCDRC, Cuttack

Submit the complaint along with copies for each opposite party, your affidavit, and all documents. You can file in person or now also through the e-Daakhil online portal.

Attend hearings

The Commission serves notice to the opposite party, who files a reply. After arguments, the Commission passes its order — typically within 3–6 months for simple cases.

Limitation period: Consumer complaints must be filed within 2 years from the date the cause of action arose. Do not delay — approach a consumer lawyer as soon as possible.
