Why Property Registration is Mandatory in Odisha

Under Section 17 of the Registration Act 1908, any document that purports to create, assign, limit or extinguish rights in immovable property valued above ₹100 must be registered. In practice, all sale deeds for land and buildings must be compulsorily registered. An unregistered sale deed is inadmissible as evidence in a court of law. Even if you have paid full consideration, an unregistered deed gives you no legal title to the property. Registration is the step that creates enforceable legal ownership.

Step-by-Step Registration Process

Verify title and ownership of property

Conduct a thorough title search. Check the chain of ownership going back at least 30 years. Obtain an Encumbrance Certificate (EC) from the Sub-Registrar office to confirm the property is free from mortgages and encumbrances.

Prepare sale deed with a property lawyer

A property lawyer drafts the sale deed with all required clauses — correct legal description of property, boundaries, consideration amount, possession date, and indemnity clauses. A poorly drafted deed can cause disputes for years.

Calculate and pay stamp duty

Stamp duty is calculated on the market value or the actual consideration amount, whichever is higher. Pay through e-SBTR (electronic Secured Bank and Treasury Receipt) or at designated banks. Non-payment or under-payment attracts heavy penalties.

Book appointment at Sub-Registrar office

Book an appointment through the IGRS Odisha portal or in person at the Sub-Registrar office that has jurisdiction over the property location.

Present parties and witnesses at Sub-Registrar

On the appointment date, both buyer and seller must appear in person before the Sub-Registrar with two witnesses. Original documents and identity proof (Aadhaar) of all parties are required. The Sub-Registrar will verify identities.

Collect registered sale deed

After the Sub-Registrar affixes the registration seal and endorsement, collect the registered sale deed. This registered document is your conclusive proof of legal ownership.

Identity proof of both buyer and seller (Aadhaar card / PAN card)
Address proof of both parties
Property tax receipt (latest) showing no dues
Encumbrance Certificate (EC) for the property
NOC from relevant authority if applicable (housing society, bank if mortgaged)
Passport-sized photographs (2 each for buyer, seller, and witnesses)

Which Sub-Registrar Office in Cuttack?

The Sub-Registrar office is determined by the location of the property, not where the buyer or seller resides. For properties within the Cuttack Urban area, the relevant office is the Sub-Registrar, Cuttack Sadar. For rural areas of Cuttack district, you will need to approach the Sub-Registrar of the relevant block or tahasil. Your property lawyer can confirm the exact office based on the survey number and location of your property.

Important: An unregistered sale deed does not confer legal title. If you paid money but the seller refuses to register, you must file a Specific Performance suit in the Civil Court seeking a court order to compel the seller to execute and register the sale deed. Act before the limitation period of 3 years expires from the date the seller refused to perform.
