Right to Maintenance During Divorce Proceedings

Under Section 24 of the Hindu Marriage Act 1955 (HMA), a wife can apply for interim alimony (maintenance pendente lite) as soon as divorce proceedings are filed. The court awards monthly maintenance to the wife pending the final disposal of the divorce case, taking into account the husband's income and the wife's needs. Litigation expenses are also covered under this provision. This ensures the wife is not left without financial support during what can be a lengthy legal process.

Right to Permanent Alimony

Section 25 HMA empowers the court to award permanent alimony at the time of passing the final divorce decree. The court considers the wife's standard of living during marriage, her earning capacity and assets, the husband's income and property, the duration of the marriage, and the conduct of both parties. Permanent alimony can be a lump sum or monthly payments. Courts in Odisha have awarded permanent alimony ranging from one-third to one-fifth of the husband's monthly income depending on facts.

Right to Matrimonial Home

A wife has the right to continue residing in the matrimonial home during divorce proceedings. She cannot be forcibly evicted without a court order. Under the Protection of Women from Domestic Violence Act 2005, a wife has a right to reside in the shared household regardless of whether she has any ownership interest in it. Courts can pass residence orders protecting this right.

Right to Return of Stridhan

Stridhan is the wife's absolute property — it includes jewellery, gifts, and cash given to her before, at, or after the marriage by her family, the husband, or the in-laws. Under Section 27 HMA, the court can direct delivery of property jointly owned or claimed. Withholding stridhan amounts to criminal breach of trust under Section 406 IPC. A wife can file both a civil application in the divorce proceedings and a criminal complaint for stridhan recovery.

Right to Child Custody

The mother is generally preferred for children under 5 years of age, as courts consider that young children need the mother's care. For older children, the court determines custody based on the best interest of the child — considering the child's educational needs, emotional bond with each parent, stability of home environment, and the wishes of the child (if old enough). A wife can apply for interim custody at the commencement of proceedings and final custody orders at the conclusion.

Right to Residence Under the DV Act

The Protection of Women from Domestic Violence Act 2005 provides powerful civil remedies alongside criminal proceedings. A wife can obtain residence orders (right to stay in matrimonial home), protection orders (restraining the husband from committing violence), and monetary orders. These remedies can run parallel to divorce proceedings and provide immediate relief.
