What is a hypothecated vehicle and what rights does the borrower have?

A hypothecated vehicle is one purchased on loan where the financier holds a charge over it as security until the loan is repaid, recorded in the RC. The borrower retains possession and use of the vehicle, but the financier can pursue repossession on default — subject to following due notice and legal procedure, as reaffirmed in recent court rulings on borrowers' rights.

The bank has not removed the hypothecation from my RC even after I repaid the loan — what can I do?

You can send a written request to the bank/NBFC for a No Objection Certificate and request them to update the hypothecation removal with the RTO. If the lender delays unreasonably, a legal notice followed by a consumer or civil complaint may be pursued, depending on the facts and the lender's response.

Can I sell a hypothecated vehicle before the loan is fully repaid?
